No. 04-17353, 05-15044, 06-15904, April 24, 2007) 日米友好通商航海条約と内部通報者保護法安藤誠二ハワイ航空契約サーヴィス社(HACS)から派遣され日本航空(JAL)国際便に搭乗した契約乗務員(contract flight crews)二名が、安全に関する日・米航空法及びJAL 社内規定に違反する事実を通報したため差別報復(様々なハラスメントの後、搭乗できなくされた)を受けたと主張して、内部通報者(whistle blower)の保護に関するカリフォルニア州法と連邦法を根拠に、アメリカ連邦裁判所に救済を求めた事件である。 原告の乗務機関士(flight engineer)Martin Ventress と民間航空機長(commercial captain) Jack Crawford は、当初カリフォルニア州中部地区連邦地裁に訴えたが、被告のJAL とHACS の移送申立を認めた裁判所が事件をハワイ連邦地裁に移送した。移送を決定した理由は、原告の申立事実が国際空域またはハワイで起きたこと、及び証人とHACS の人事記録の所在地がハワイであるため、ハワイが比較的便宜法廷地(more conveinient forum)と判断されたことにある。 ハワイ連邦地裁は、原告のJAL に対する全ての請求は日米友好通商航海条約(The Friendship, Commerce, and Navigation Treaty, US-Japan, April 2, 1953, 4 UST 2063)によって阻止されると訴答に基づき判断し(judgment on pleadings)、原告の訴えを棄却した。また原告・HACS 間の争いに関しては、HACS・原告間の雇用契約に強制的仲裁条項が含まれているため、米国仲裁協会商事規則に従った仲裁手続への移行を命じた。 Ventress とCrawford は、第9 巡回区連邦控訴裁判所に控訴した。上訴 ... 2008年04月29日再生回数 1371 |
