 | 上百名群众旁听成都罗兴权案当庭谴责青白江区法官违法审理 12月22日上午10点20分，成都市青白江区拆迁户被以涉嫌赌博罪一案一审开庭审理，到庭参加庭审的群众有130多名。 本案被告人之一罗兴权，是一个拆迁户，由于拒绝在无理的拆迁协议上签字，一家人多次被构陷，被拘留，据家人介绍，这次又是有人故意涉及圈套，利用公权力迫使其他人指控他。 罗兴权拒绝认罪，而指控他的证据就只有另外几名被告人矛盾百出的"供述"这些供述惊人的一致，指向罗兴权抽头，而真正的老板，却一会以心脏病为由取保候审，当庭又说的是高血压，在检方询问他涉案经过的时候，这位老板说得惊人的精确，然而，在律师打乱次序再次询问这些事实的时候，他却说不知道，记不得了。为了弄清真相，律师举手希望再次询问这位被告人，法官却无理剥夺了律师的发言权，因此，引来旁观群众的不满，休庭后纷纷责问审判长，审判长因而宣布改日再审。 据悉，本案判决书早已写好，如果今天法官能强行审理完毕，就会当庭宣判，而且结果已经定好了，其他六名犯罪嫌疑人以认罪态度好为由，判缓刑，罗兴权判实刑。 由于律师凌厉的询问，使得法官的原本的计划很难完成，如果再继续问下去，整个案子就露馅了，为此审判长不得不阻止律师继续询问，甘愿违法，违反程序也不敢让律师对这个被告人继续询问下去，即使律师提出要求审判长回避，法律明文规定只能又院长决定，而这位法官居然藐视法律，自己就宣布了驳回律师的申请。 罗兴权丈夫陈道楷:13350846979 参与首发，转载请注明出处。(www.canyu.org) 2011年12月25日再生回数 120 |
